A FIR was registered under section 302 and 304 of Indian penal code at Badarpur Police satation against petitioner. Our learned counsel of the firm on behalf of petitioner states that the petitioner is covered by High Powered Committee Guidelines dated 11.05.2021, hence on request that the petition be treated as petition seeking interim bail.
The guidelines says that under trial prisoners (UTPs) facing trial for a case under Section 302 IPC and are in jail for more than two years with no involvement in any other case can be considered for grant of interim bail for a period of 90 days.
The petitioner in this case has undergone sentence of 3 years and 11 month approx. and had no other involvement in any other case.
Justice Yogesh Khanna held that petitioner hereby granted interim bail for 90 days on executing a personal bond of Rs.20,000/-directed to furnish his contact details/address to the Investigating Officer and shall make video call to the Investigating Officer in the first week of every month and shall keep his mobile location app open at all time. The petitioner will not contact or threaten the witnesses in any manner, lest it shall be a ground for cancellation of bail.
